Terms & Conditions
Please read the following Terms & Conditions which apply to the use of any voucher booked or purchased through the Excapades website under the domain name excapades.com.au (the “Website”). By booking or purchasing a voucher through this Website, you agree that you have already read, acknowledged and accepted the Terms & Conditions. Any information you provide must be legitimate and authentic. You must update your personal profile should any of your current details change. These Terms & Conditions may be subject to change, so please read them carefully before each new booking or purchase is made. Suppliers
Excapades acts as booking agent between customers and the suppliers who directly provide customers with the services for which Excapades vouchers apply. Excapades does not provide these services itself and is not responsible for the acts or omissions of any supplier or outside party in relation to these services or otherwise. We work to deal with suppliers who operate safely as well as providing maximum enjoyment for their customers. Every Excapades voucher issued has to adhere to the terms & conditions set by each supplier.
While Excapades takes all necessary steps to make sure that every supplier is licensed and compliant, in some instances where a supplier is not fully licensed or compliant with any applicable law, bylaw or regulation, Excapades cannot accept any responsibility either legal or equitable for any loss suffered by you or any third party as a consequence.
Service information
Any information on this Website describing the adventures for which vouchers are offered is based on information provided by the suppliers of those adventures. While we aim to ensure that information is kept current and correct, there may be some instances where modifications are made to the event or schedule. Upon confirmation of your booking, the individual supplier will provide you with all relevant and up-to-date details. Any further subsequent changes will be notified to you by that supplier. Participation is conditional upon acceptance of the description of the product detailed at the time your booking is confirmed.
Any graphics, photos, or illustrations used on this Website may not be fully representative of the adventure described. Graphics may only be used as a guideline to what a customer can generally expect and there may be variations including in relation to vehicles, equipment, scenery and settings.
Excapades does not warrant the accuracy, adequacy or completeness of any material on this Website. All information is subject to change without notice.
Schedules and timing of any adventure listed is approximate, and referenced as a general guideline to the amount of time you spend on each activity and length of time you will be expected to spend at the supplier’s venue. Please also be aware there may be more than one party present, so in general, you will be required to take your turn with other group members and accept some waiting time may be involved. Scheduling of events may run in a different order.
Location
Excapades continues to seek and add exciting locations to its portfolio. While many of our suppliers offer the best locations throughout Australia, on occasions, existing venues may need to be retracted. Each venue has its own set of terms & conditions (available on request). Your participation is conditional upon acceptance of these.
Restrictions
Some adventures are subject to age, height, fitness or other requirements that may prevent some customers from carrying out those adventures. Please read the full requirements and restrictions detailed under each listing on the Website before you make a booking. Each supplier will also send out their own information pack upon receipt of your booking. Restrictions will be highlighted, again, within the information pack. You must notify Excapades within seven days if any of the restrictions set out in the information pack apply to you. If you have already confirmed your booking, you may still be liable to pay for the fees of that booking and/or supplier/agency cancellation charges, because you did not meet the minimum requirements already outlined under the adventure listing on the Excapades website.
Voucher Validity
Experience Vouchers - Vouchers purchased for specific adventures eg Skydiving are valid for (6) six months from the date of purchase. Please note that you must have PARTICIPATED in the experience prior to this expiry date.
Gift Vouchers - Gift Vouchers with a dollar value are valid for (12) twelve months from ‘date of purchase’.
Voucher expiry dates are clearly printed on each voucher. It is your responsibility to use your voucher before this expiry date. Many experiences fill very quickly, in some cases up to eight weeks in advance. To avoid disappointment and ensure you participate before this expiry date please book well in advance.
Voucher Extension - Experience Voucher
If you are unable to participate in your experience prior to the Experience Voucher expiry date, your voucher can only be extended under the criteria listed below. Extensions are subject to administration fees. Voucher extensions can only be granted for experiences that are still active on the eXcapades website. If the experience has increased in pricing since the original Experience Voucher purchase you will be required to pay the difference in pricing, in addition to the relevant administration fee. Vouchers can only be extended once, and you must participate prior to the extended expiry date. You voucher CANNOT be extended if you have already REDEEMED the voucher – requested booking dates.
1. If your Experience Voucher is still valid
If your voucher has yet to expire when you contact eXcapades, but you still require an extension, we can extend your voucher for an administration fee of $15.00 per month, for a maximum of 3 months.
2. If your Experience Voucher has expired within the last 30 days
If your voucher has already expired and you contact us within 30 days of its expiry, we can extend it for an administration fee of $30 per month for a maximum of 3 months.

If your Voucher has expired for more than 30 days
If your voucher has expired for over 30 days, under no circumstances can we extend your voucher.
Voucher Extension - Gift Voucher
Under no circumstances can Gift Voucher expiry dates be extended.
Gift Vouchers can be used just like cash to purchase any experience in our range. You will then be issued an Experience Voucher for the experience you select, and have a further six months to participate in this chosen experience/s.
Return & Exchange Policy
eXcapades Experience and Gift Vouchers are strictly non-refundable and are not redeemable for cash, under any circumstance.
You may exchange your Experience Voucher for another Experience Voucher once only at no charge, provided the voucher has not been redeemed and has not expired. If the new experience you choose be higher in price than your original experience, you will be required to pay the difference. Should the new experience you choose be lower in price that the original experience, unfortunately no refunds or credits will be allocated. The expiry date of the transferred voucher will remain the same as that on the original voucher.
Voucher cannot be transferred to another person.
Excapades Gift Voucher (Dollar Amount)
Please note that if you are unable to use all of the dollar credit amount, we will not be able to give you any cash credit. Any remaining credit can be used towards the cost of another Excapades Adventure or Gift Package. Please note that this MUST be done prior to checking out after your first selection, or unfortunately any remaining credit will be forfeited. If you choose a package that is more expensive than the dollar amount shown, you will have to pay for the difference.
Booking Fees
All fees are quoted in Australian Dollars. Fees include Goods and Services Tax (GST) at the existing rate of 10 per cent. Excapades retains the right to make changes to fees without prior notice.
Book Early
We cannot guarantee availability for all adventures so make sure you book well in advance to avoid disappointment, especially when approaching peak periods. Bookings should not be considered validated until you are notified that your redemption code has been verified between Excapades and the appropriate supplier.
Cancellations
Once you have made your booking but are unable to attend your adventure, you may be liable to pay for cancellation charges, and, risk losing your voucher if your place is unable to be filled by the supplier on the day.
Many adventures offered by Excapades could be affected by weather conditions. If you’re unsure whether your adventure will be affected on the day, please check with the supplier who will be able to advise you. If an adventure is cancelled by the supplier due to weather or any unforeseen circumstances, every effort will be made to contact you as quickly as possible to offer you a suitable replacement date.
Liability
Subject to any responsibilities implied by law and which cannot be excluded, Excapades, and its directors, employees, agents and contractors, are not liable to you for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defence or settlement costs) whatsoever, whether direct, indirect or consequential, arising out of or referable to any material on this Website, to any material on linked websites, to any adventures described on this Website, or to access or use of the Website by you, howsoever caused, whether in contract, tort including negligence, statute or otherwise.
Adventure Day
If you experience any problems during your adventure, it is in your best interest to discuss it with the supplier management as soon as possible, so they can try to amend the situation and put matters right. If you have any further complaint after the event, please inform Excapades in writing as we always aim to have our suppliers provide the highest standards of service.
Collection
Vouchers are usually sent via email or through Australia Post’s express post service. Excapades is not accountable for any vouchers getting lost or intercepted in transit. For greater security, Excapades can offer a courier service to listed addresses in all major cities and some surrounding suburbs. The courier service will incur additional charges and deliveries will need to be signed upon receipt.
Insurance
All suppliers are required to hold public liability and/or third party insurance. Some of the adventures can involve personal risk which you should be mindful of. If you are uncertain, please contact Excapades where we will be happy to provide you with further information. Ultimately, suppliers have complete operational control of the adventure on the day over which we have no authority. With regard to your own insurance policy and supplier third party coverage, it is your responsibility to make your own enquiries.
Governing Law
This agreement is upheld by the law in force in the State of Victoria, Australia. |
